The Kenyan Court of Appeal has definitively dismissed Paul Ndung’u’s attempt to reopen a legal dispute over the SportPesa trademark, ruling that his application lacked merit. The three-judge bench awarded costs to Milestone Games, effectively closing the chapter on the contentious case.
This marks the second recent legal defeat for Mr Ndung’u against SportPesa. In November 2025, the High Court of England and Wales similarly dismissed a claim filed by Ndung’u, concluding that there was no substantive basis to his legal action.
Commenting on the ruling, Ronald Karauri, CEO of SportPesa, said the judgment provides much-needed clarity and allows the company to focus on its strategic initiatives.
“The court’s decision to reject this baseless bid to reopen a settled case brings this matter to a welcomed conclusion. For years, we have faced a pattern of vexatious litigation and media manipulation. Now, we are vindicated in both Kenya and England, with a KSh 374 million costs order in our favor,” Karauri said.
He added that the victory paves the way for SportPesa to accelerate its market activities and further its community and sporting initiatives. “SportPesa is no longer looking back. Our focus remains on the ‘SportPesa Effect’ — investing in communities, building infrastructure, supporting athletes, and delivering on our KSh 1.12 billion commitment to Kenyan sport,” he said.
SportPesa also reaffirmed its commitment to sports development with a KSh 120 million multi-sport sponsorship programme across boxing, rugby, and rallying in Kenya. The initiative aims to provide structured opportunities for athletes while strengthening the country’s sports ecosystem.
“As we move forward, our investment in Kenyan sport continues, including our support for rugby, rally, boxing, and the Magical Kenya Open. Supporting sport remains central to our brand identity,” Karauri said.
With the legal matters behind it, SportPesa now aims to consolidate its position in the African sports market, focusing on nurturing talent from grassroots to international levels.
